How Optery Works for California Residents Under the California Consumer Privacy Act (CCPA)
If you are a California resident, the California Consumer Privacy Act (CCPA) gives you privacy rights, including the right to opt-out of (say “no” to) the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising (e.g., targeted advertising) ("Right to Opt Out of Sale or Sharing") and the right to request that a business delete any personal information about you that the business collected from you ("Right to Deletion").
The CCPA allows you to use a service like Optery as an Authorized Agent to exercise your Right to Opt Out and your Right to Deletion on your behalf. When you subscribe to Optery's paid Removal Services, you can choose to sign a Limited Power of Attorney (LPOA) or other written authorization, which some data brokers require to verify our authority to act on your behalf. When we exercise your Right to Deletion or your Right to Opt Out of Sale or Sharing on your behalf, we do so through the method specified by the business who has your personal data. This may involve submitting an online Opt-Out Form or sending a direct email to the privacy team and will depend on that company's policies and procedures. Under the CCPA, business are required respond to an Opt-Out of Sale or Sharing Request within 15 days of receiving the request and to a Deletion Request within 45 days of receiving the request. Sometimes the CCPA allows the business to have an additional 45 days to respond to a Deletion Request, but the business must explain if and why it needs that extra time to respond.
In some circumstances, the business may ask us (or you) for additional information necessary to comply with the request, such as information to verify your identify or otherwise prove that you are the consumer who requested to exercise your privacy right.
