How Optery Works for Minnesota Residents Under the Minnesota Consumer Data Privacy Act (MNCDPA)

If you are a Minnesota resident, the Minnesota Consumer Data Privacy Act (MNCDPA) gives you privacy rights, including the right to opt-out of (say “no” to) the sale of your personal data or the use of your personal data for targeted advertising or certain kinds of profiling ("Right to Opt Out").

The MNCDPA allows you to use a service like Optery as an Authorized Agent to exercise your Right to Opt Out on your behalf. When you subscribe to Optery's paid Removal Services, you can choose to sign a Limited Power of Attorney (LPOA) or other written authorization, which some data brokers require to verify our authority to act on your behalf. When we exercise your Right to Opt Out on your behalf, we do so through the method specified by the business who has your personal data. This may involve submitting an online Opt-Out Form or sending a direct email to the privacy team and will depend on that company's policies and procedures. The MNCDPA requires the business to respond to your rights request within 45 days of receiving the request. Sometimes the MNCDPA allows the business to have an additional 45 days to respond, but the business must explain if and why it needs that extra time to respond.

In some circumstances, the business may ask us (or you) for additional information necessary to comply with the request, such as information to verify your identify or otherwise prove that you are the consumer who requested to exercise your Right to Opt Out.

The MNCDPA also provides you with the right to request that a business delete personal data about you ("Right to Deletion"). If you request that Optery exercise your Right to Deletion on your behalf, we will contact the business and follow their process for fulfilling privacy rights. However, under the MNCDPA, a business is not legally required to honor a deletion request that comes from an authorized agent like Optery. The only type of request submitted by authorized agents that businesses are required to fulfill under the MNCDPA is an opt-out request.
